Terms of Service

Who we are, and what this is

MemberPress.ai is built and operated by Caseproof, LLC — the team behind MemberPress. These terms are the agreement between you and us for memberpress.ai and the MemberPress.ai plugin running on any WordPress site you connect. By creating an account, connecting a site, or using the service, you're agreeing to them, and to our Privacy Notice, which explains how we handle your data.

Your account

You need to be at least 18 and able to enter a contract. Keep your credentials to yourself — what happens under your account is yours to answer for, so tell us fast at legal@memberpress.ai if you think someone else has gotten in. Give us accurate account details and keep them current.

The service

MemberPress.ai is an AI advisor and site-setup assistant for WordPress membership businesses. With your authorization, it connects to your WordPress site, installs the plugins you approve — including the free version of MemberPress itself, if your site doesn't already run it — and then works with your site's business data (members, revenue, subscriptions, and content) to set up memberships and courses, answer questions, and carry out the work you approve. There are two plans: Free, which reads your site and explains what's happening, and Paid at $79/month per site, which does the work — building memberships, writing courses, and fixing what's costing you money.

MemberPress.ai is currently in public beta. Beta pricing is 50% off the standard Paid rate. Verified MemberPress customers get their first 30 days of Paid free. What each plan includes can evolve as the product does.

Billing

Paid is billed monthly through Stripe, and renews automatically until you cancel. Eligible accounts — verified MemberPress customers — start Paid with a 30-day free trial: you pay nothing up front, and unless you cancel before the trial ends, it converts automatically into the paid subscription at the beta rate then in effect. You can cancel anytime from your billing page; cancellation takes effect at the end of the period you've already paid for, and you keep Paid until then. If a renewal payment fails, we'll retry and tell you before anything changes. Refunds: [TBD — refund policy]. Prices can change, but never mid-period and never without notice before your next renewal.

Your content and your connected site

Your data stays yours. Connecting a site authorizes us to install the plugins you approve on it, and authorizes the MemberPress.ai plugin running on your own site to work with your business data — members, transactions, subscriptions, and content — so the advisor can act on it. Installation uses a site credential created only for that purpose: it is encrypted, used once, and not retained once the install completes. By connecting a site, you warrant that you have the right to share its data with us, including whatever notice or lawful basis your own members are owed. For member data processed this way, you are the controller and we act as your processor under our data processing agreement, available on request via legal@memberpress.ai. Disconnecting a site revokes the connection and stops further processing; what stays and what goes is spelled out in the Privacy Notice.

Acceptable use

Don't use MemberPress.ai to break the law, to process data you have no right to process, to probe or disrupt the service, to resell access, or to try to extract other customers' data — every account is isolated, and attempting to cross that line is grounds for immediate termination. Don't use automated means to hammer the service beyond what the product is built for.

AI outputs — read this one

The advisor generates its answers with AI, and AI-generated answers can be wrong — confidently wrong, occasionally, including about numbers. Its output is generated advice, not fact, and not legal, financial, tax, or other professional advice. You stay responsible for your business decisions. Check anything that matters before you act on it, the way you'd check advice from a smart colleague who's sometimes mistaken. We work hard on accuracy, and the product tells you when it doesn't know something — but you should not treat any output as a guarantee. Anything the advisor would publish, refund, or change on a subscription is held for your explicit approval first; see "Our commitments" below.

Our commitments

These boundaries are part of the deal: no customer content, prompts, or transcripts are used to train AI models — same policy for Free as Paid; every write previews as a dry run unless you explicitly execute it; refunds and subscription changes require a second, human confirmation; and credentials never leave your site. If these terms and our published guardrails ever seem to conflict, the stricter protection for you wins.

Intellectual property

We own the service — the software, the design, the name. You own your data and your site's content. The advisor's answers to you are yours to use for your business; we claim no ownership over them.

Termination

You can stop using MemberPress.ai anytime: disconnect your sites, cancel Paid, and email us to delete your account. We can suspend or terminate accounts that violate these terms — for serious violations, immediately; otherwise we'll warn you first. If we ever discontinue the service, we'll give you reasonable notice and time to take your data with you.

Disclaimers and limitation of liability

The service is provided "as is" and "as available" — we don't promise it will be uninterrupted or error-free, and the AI-outputs section above applies to everything the advisor says. To the maximum extent the law allows, we're not liable for indirect, incidental, or consequential damages, or for business decisions made in reliance on advisor output. [TBD — liability cap and carve-outs, e.g. a cap at fees paid in the prior 12 months, with carve-outs for data-protection breaches, gross negligence, and willful misconduct.] Nothing here limits liability that can't legally be limited.

Governing law and disputes

These terms are governed by the laws of [TBD — governing law], and disputes go to [TBD — venue, and whether arbitration or courts]. Before it gets there, email us — most disputes are a misunderstanding or a bug, and we'd rather just fix it.

Changes to these terms

We can update these terms as the product evolves. For material changes we'll notify account holders before they take effect; continuing to use the service after that is acceptance. The date at the top always tells you when they last changed.
